1. Acceptance of these terms
These Terms of Service (“Terms”) are an agreement between you and Flagon Forge LLC (“Flagon Forge,” “we,” “us”), a limited liability company based in Pensacola, Florida. By accessing flagonforge.com, joining the waitlist, or using the Flagon Forge platform (together, the “Service”), you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years of age to use the Service. If you are between 13 and the age of majority in your jurisdiction, you may use the Service only with the consent of a parent or legal guardian. We do not knowingly permit use of the Service by children under 13.
3. The Service; beta status
Flagon Forge is an AI-powered, asynchronous tabletop role-playing game platform. The Service is currently in a pre-release stage (waitlist and closed beta). Features may change, be interrupted, or be discontinued at any time, and beta access may be granted, limited, or revoked at our discretion. Game progress, characters, and other data created during a beta period may be reset or deleted as part of development.
4. Accounts
When account registration becomes available, you are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorized use of your account.
5. AI-generated content
The Service uses large language models to generate narrative content in response to your actions. AI-generated content is produced automatically, may be inaccurate or unexpected, and is provided for entertainment purposes only. It does not represent the views of Flagon Forge and should not be relied on as factual, professional, or personal advice. We apply safety measures to the AI experience but cannot guarantee that all generated content will be free of errors or material you find objectionable.
6. Your content and conduct
You retain ownership of the original content you submit to the Service (such as character concepts and player actions). You grant Flagon Forge a worldwide, non-exclusive, royalty-free license to host, store, process, and display that content as needed to operate and improve the Service. You agree not to use the Service to submit content that is unlawful, harassing, hateful, sexually explicit involving minors, or that infringes the rights of others; not to attempt to bypass safety systems, rate limits, or access controls; not to reverse engineer, scrape, or resell the Service; and not to disrupt the Service or other players.
7. Flagon Forge intellectual property
The Service — including the Flagon Forge platform, software, visual design, branding, and the worlds, adventures, and characters we create — is owned by Flagon Forge LLC or its licensors and is protected by intellectual property laws. The FlagonForge tabletop ruleset is published separately under its own open license; that license governs the ruleset text, and these Terms govern the platform. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from the Service.
8. Subscriptions and payment
The Service is currently free during the waitlist and beta period. We expect to offer paid subscription plans in the future, processed by a third-party payment provider. If paid plans launch, pricing, billing terms, renewal, and cancellation details will be presented at the point of purchase and will supplement these Terms. Any promotional pricing we designate as locked for early supporters (such as a founders rate) will be honored as described at the time of the offer.
9. Termination
You may stop using the Service at any time, and may leave the waitlist via the unsubscribe link in any email we send. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) will survive.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that game data will be preserved during the beta period.
11. Limitation of liability
To the maximum extent permitted by law, Flagon Forge LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or fifty US dollars ($50).
12. Indemnification
You agree to indemnify and hold harmless Flagon Forge LLC and its officers, employees, and agents from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Service, or your violation of these Terms.
13. Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or the Service will be brought in the state or federal courts located in Escambia County, Florida, and you consent to their jurisdiction.
14. Changes to these terms
We may update these Terms as the Service evolves. If we make material changes, we will update the “Last updated” date above and, where reasonable, notify you by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
